We live in a building on the water in Miami Beach. Last year, there was water pouring down the wall in my daughter's room when it rained. I called maint., and they came & told us to simply keep the window shut tight. I asked if the stains on the wall were mold and was told "no". Over the next several months, my two daughters (ages 2 & 15 at the time) were constantly complaining of "tummy aches", head aches, fatigue, etc., Because we were told it wasn't mold, I was no longer even concerned about it and proceeded to remove foods and things I thought might be harmful. Nothing helped. My youngest daughter got worse and started having serious respiratory issues. We kept taking her to the doc where they had no idea why her breathing was "all of a sudden" terribly challenged.

After taking her to a specialist in The Bahamas (where my husband is from) where they still could not diagnose anything other than asthma, we decided to have the place tested for mold. I went to the business office & stated we were going to test for mold & got a copy of my original complaint a year prior. When the inspector tested the walls in my kids room, we were horrified when the results came back showing TWO types of mold that he said weren't even supposed to be indoors. Our building INSISTED on using their "in-house certified mold remover" and advised us to REMAIN in the apartment which we refused (they had to pay for us to stay in a hotel room and only did so for 24 hours. I came back to the place 4 hours after they began the work to find it completed.)

We assumed the mold was removed and came back. Prior to the removal, we never allowed our toddlers (now 2 and 3) to play in the room but once we were told the mold was gone, we allowed them to play in there. Within two weeks my son, who NEVER had breathing issues, was in the emergency room on a ventilator for 7 hours!!! I went back to the building and requested a "follow up" to make sure the mold was gone. They refused an air quality test but said they'd do a "moisture test".

We also found out yesterday that the property manager never rec'd the copy of the mold report that I sent her from the independent testing; meaning they didn't even know what type of mold they were working with. Nor did the "removers" use blue tape, masks, or a heppa vac.

We are now attempting to see what else can be done other than having the place re-tested. If the re-test comes back that there is still mold, do we have any recourse of action to take?
